Do You Need a Brazil Overflight Permit?

Not as a universal “overflight permit” for every foreign civil transit. For foreign civil aircraft covered by ANAC Resolution 178, including qualifying non-remunerated operations and foreign air-taxi operations, the operator or pilot must communicate the planned landing or overflight to ANAC before filing the flight plan. The regulation requires flight date/time, route, Brazilian entry point, aircraft nationality/registration and type, and purpose of flight.

An AVANAC is a different authorization. Under the same framework it is required when, after the first landing at an international airport in Brazil, the foreign aircraft intends to proceed to another airport within Brazil. That application has a published minimum of 24 hours before estimated landing.

Brazil Overflight Permit Requirements

• Aircraft registration and aircraft type
• Operator name and full contact details
• Complete flight schedule with UTC date and time
• Departure airport and destination airport
• Full route including Brazil FIR entry and exit points
• Purpose of flight and call sign / flight number
• Lead passenger details where applicable
• Consignee and consignor details for cargo flights where applicable

Brazil Overflight Notification and AVANAC Timing

For operations covered by ANAC Resolution 178, the overflight/landing communication must be made to ANAC before the flight plan is submitted; the rule reviewed does not establish a generic 48-working-hour overflight-permit lead time. If an AVANAC is required for onward domestic operation after the first international landing, the application is submitted at least 24 hours before the estimated landing, with exceptions possible for emergency or exceptional cases.

Brazil AVANAC Validity and Operational Changes

The reviewed ANAC rule does not support a generic “+72 hour overflight permit” validity statement. An AVANAC, where required, has its own validity conditions; Resolution 178 provides an initial period of 60 days, subject to the regulation's termination conditions and possible extensions. Ordinary overflight communication should remain aligned with the actual route, timing, aircraft and flight plan.
